Judge approves Apple settlement

In the US, judge Denise Cote has granted final approval to a settlement deal in Apple’s ebook price-fixing case, reports Publishers Weekly. Under the terms of the deal, however, Apple will only pay the agreed US$400 million (A$464 million) to consumers ‘if the liability finding survives the appeal process’. The company will pay US$50 million (A$58 million) ‘if the liability question is vacated or remanded for further proceedings’ and if the liability finding is reversed, it will pay nothing. The US Second Circuit court is due to hear arguments on Apple’s appeal of Judge Cote’s 2013 liability finding on 15 December but the agreement ‘affords the parties the opportunity to appeal [Cote’s] liability finding all the way to the Supreme Court, so a final payout could be many months, if not years away,’ reports Publishers Weekly.
